Babalola claims that the 104-page book, which critiques Nigeria’s legal system, contains defamatory content that damages his reputation. The legal tussle was triggered after Babalola filed a petition with the Ekiti State Police Command, leading to Farotimi’s arrest in Lagos and subsequent arraignment before a Magistrate Court in Ado Ekiti.

Dalung, however, opined that Babalola should have ignored the case instead of pursuing it, suggesting that by doing so, he had exposed himself to public criticism and risked tarnishing his legacy. According to Dalung, Farotimi is a well-respected human rights activist with a significant reputation, especially among Nigerians, making it difficult for the public to understand the defamation claim.

Dalung went further to advise Babalola to have approached Farotimi privately, offering guidance rather than pursuing legal action. He emphasized that by engaging in the lawsuit, Babalola had effectively pitted himself against public opinion, which may not bode well for his reputation in the long run.

In a recent statement on the Mic On Podcast, former Minister of Sports Solomon Dalung commented on the ongoing defamation case between Chief Afe Babalola and activist lawyer Dele Farotimi. Dalung expressed doubts that Afe Babalola, a Senior Advocate of Nigeria and prominent elder statesman, would succeed in his defamation suit against Farotimi, which stems from Farotimi’s book Nigeria and its Criminal Justice.
