… Insist on change of Justice Binta Nyako
By Divine Sam
Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), has rejected the Nigerian government’s request to resume his trial, insisting that Justice Binta Nyako, who had previously handled his case, must recuse herself.
His lead counsel, Aloy Ejimakor, argued that the order for Justice Nyako to step down, issued on September 24, 2024, was still valid and binding, as it had not been overturned by any competent court.
Kanu, who faces charges of treasonable felony and terrorism, has repeatedly stated that he no longer trusts the judge’s impartiality and called for her to step aside.
In the previous court session, Kanu criticized the court for allegedly disregarding a Supreme Court order and expressed his lack of confidence in the trial process.
Despite this, the prosecution urged Justice Nyako to proceed, but Kanu insisted that his objections were based on legal grounds rather than personal animosity. Justice Nyako ultimately agreed to recuse herself, forwarding the case to the Chief Judge of the Federal High Court for reassignment.
The Chief Judge, however, directed that Kanu must formally apply if he still wished for Justice Nyako to step aside, leading to the current standoff.
